The present book is a contribution to the clarification of operating procedures used by the current legislation of the European Union for the protection of the right to family unity, and in particular the right to family reunification of individuals. From a formal point of view the right to family reunification, enjoys international and national protection. This book examines the protection of family life and family reunification within the framework of international conventions on human rights, family reunification and the protection of family life in the area of justice, the rights of family members of European citizens in the EU legislation and the case law; the rules set by the Directives 2004/38/EC and 2003/86/EC, the relationship between EU legislation on family reunification and the respect of national rules governing the entry and residence of migrants. An important part of this work is dedicated to the right of family reunification in the national law, namely to protect the family unit in Italy in accordance with the Consolidated immigration no. 296/98.
Erjona Canaj holds a PhD Degree in International and European Union Law from the University of “La Sapienza”, Rome. After a Degree in Law she had a Master Degree in Family Law from the same university. Ms Canaj is a member of the Chamber of Attorney, in Roma and in Albania as well. She is a lecturer of Human Rights and Migration Law (2011/2012 and 2012/2013) whereby she held the position of Head of Department of International and European Union Law, Faculty of Law. She has been actively engaged in project development in the area of European Union law, family law, human rights and refugee law as well as in research at the national and regional level. Ms Canaj has published several articles and she is co-authored of several academic books in the areas of expertise. She is Editorial Managing of the International Journal of Education Sciences. Actually she is a research coordinator of the Doctoral School at the European University of Albania.
Sokol Bana holds a PhD Degree in Economic Public Law at the University of “La Sapienza”, Rome. Mr. Bana holds a Degree in Law and a Degree of the Specialization School for Legal Professions from the same university. Mr. Bana is a member of the Chamber of Attorney, Roma, and Tirana (Albania). He has extensive experience as a lecturer at the University of ‘Ismail Qemali’, Vlora, whereby he held the position of Head of Department of Public Law of the Faculty of Law. He has been actively engaged in project development in the area of European Union law, family law and human rights. Mr Bana has published several articles and he is co-authore of academic books in the areas of expertise.
